Our platform provides AI-powered home search, agent matching based on verified MLS transaction data, online interview scheduling, contract negotiation tools, and agent hiring. By using our services, you agree to these terms. If you do not agree, please discontinue use of this website. Your continued use constitutes acceptance of these terms.

Eligibility

To use smover's services, you must be at least 18 years old and legally capable of entering into a binding agreement.

MLS Data Usage

Listing data displayed on smover is sourced from Multiple Listing Services (MLS), including Bright MLS. This data is displayed in accordance with MLS display rules and regulations. smover is not responsible for the accuracy of listing data provided by MLS sources. Listing information is subject to change without notice.

Intellectual Property

You retain ownership of your intellectual property submitted to smover, including portfolio content, feedback, and communications. By submitting content, you grant smover a non-exclusive, worldwide, royalty-free license to use, display, and distribute it in connection with the platform. smover's name, logo, design, and technology are the intellectual property of smover.

DMCA and Copyright

smover respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe that content on our platform infringes your copyright, please send a written notice to hello@smover.co with:

Communications

By using smover, you consent to communications via email for service-related purposes, including interview confirmations, agreement notifications, and platform updates. You can opt out of promotional communications at any time.

Account Termination

smover reserves the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms, is harmful to other users, or is otherwise objectionable. This includes but is not limited to: providing false information, harassing other users or agents, attempting to manipulate search results or agent rankings, violating fair housing laws, or using the platform for any unlawful purpose. You may also delete your account at any time by contacting us at hello@smover.co.

Indemnification

You agree to indemnify, defend, and hold harmless smover, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; or (d) any content you submit, post, or transmit through the Services.

No Warranty

smover makes no warranties regarding the accuracy of listing data, agent performance metrics, AI-generated descriptions, or search results. All information is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Usage is at your own risk. smover does not guarantee the outcome of any real estate transaction facilitated through the platform.

Limitation of Liability

To the maximum extent permitted by law, smover is not liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of its services, including but not limited to errors in listing data, agent performance, search results, or the outcome of real estate transactions. In no event shall smover's total liability exceed the amount paid by you to smover in the twelve months preceding the claim.

Dispute Resolution

Disputes will be resolved through binding arbitration under the laws of the Commonwealth of Virginia. Arbitration shall be conducted in Fairfax County, Virginia. You waive your right to a jury trial and to participate in a class action lawsuit. Any claims must be brought within one year of the event giving rise to the claim.

Force Majeure

smover shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions, power failures, internet outages, or third-party service disruptions.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

Entire Agreement

These Terms of Service, together with our Privacy Policy and Fair Housing Commitment, constitute the entire agreement between you and smover regarding the use of our Services and supersede all prior or contemporaneous agreements, communications, and proposals.

Modifications

smover reserves the right to modify these Terms of Service at any time. When we make material changes, we will update the "Last Modified" date at the top of this page and, where appropriate, notify you by email. Continued use of the Services after changes constitutes acceptance of the modified terms.
